THE WHAT? Modiface has managed to avoid answering a lawsuit where the complainant alleged that it breached Illinois’ Biometric Information Privacy Act, according to a report published by Bloomberg.
THE DETAILS The complainant was a Sephora customer who, after using Modiface’s Virtual Artist Kiosk in a Chicago branch of the LVMH-owned retailer, alleged that her face scans were collected without consent.
Modiface argued that it does not sell or market its products in Illinois and doesn’t have a business relationship with Sephora in the State. Sephora will have to answer the claim yet.
THE WHY? The court ruled that it lacked jurisdiction because the case lacked sufficient connection to Illinois.
