THE DETAILS The baby version is said to carry numerous label statements but is basically identical to the product targeted at adults and being sold at a dramatically different price, the suit alleges. The baby version contains avena sativa, whereas the adult version does not, but this is not sufficient to justify the price difference, the plaintiff claims.
THE WHY? Federal lawmakers are working to prevent companies charging a premium for products aimed at women or children – a so-called ‘pink tax’, the suit alleges, and amounts to unjust enrichment, the plaintiff claims.
