THE WHAT? The UK Court of Appeal has dismissed L’Oréal’s appeal against an earlier ruling that upheld the validity of Olaplex’s Bond Multiplier patent, according to a report published by the World Intellectual Property Review.
THE DETAILS The French beauty behemoth appealed against a 2018 High Court decision on the grounds that Olaplex had been wrongfully allowed to amend a claim of its patent.
“After three years of litigation and appeals, we are grateful that yet another court found Olaplex’s patents valid and infringed by L’Oreal,” said Tiffany Walden, COO and General Counsel at Olaplex, per the World Intellectual Property Review.
THE WHY? In this David versus Goliath battle, Olaplex is fighting hard to maintain its one advantage: innovation and agility, while L’Oréal doggedly maintains its innocence.
