Coty’s Manhattan gains trademark approval in Hungary

Coty’s Manhattan Cosmetics has won through in its battle to register a trademark for its Manhattan Supersize Seductive Eyes, according to a report published by Fashion Law.

The Hungarian Intellectual Property Office initially rejected Coty’s application on the basis that the mark refers to geographic origin, and could lead to customer confusion as the make-up itself is not made in the US but in Germany.

Hungary’s Metropolitan Tribunal, however, has rescinded the HIPO ruling, holding that, given that make-up produced in Manhattan is no more distinctive than make-up produced elsewhere, a name that references the city is not enough to bar trademark registration. The HIPO has thus granted Hungary-specific trademark protection after a new examination.
