L’Oréal prevails in Olaplex appeal

THE WHAT? L’Oréal has prevailed in the latest instalment of its ongoing battle with Olaplex. The US Court of Appeals for the Federal Circuit overturned an earlier Federal Court judgement that the French beauty giant infringed the indie’s patented hair coloring system, according to a report published by Reuters.

THE DETAILS The case has been remanded for trial in the US District Court in Delaware. Reuters reports that just one portion of Olaplex’s patent remains: that it reduces breakage from a single bleaching session, after the majority were invalidated by the Patent Trial and Appeal Board.

THE WHY? L’Oréal has been locked in an IP battle over this issue since 2016, with Olaplex inheriting its defence from Liqwd upon its acquisition in 2020.
